1 Acceptance of Terms
By creating an account, accessing, or using Post Daily, you confirm that you:
Are at least 18 years of age or the age of legal majority in your jurisdiction
Have the authority to enter into these Terms on behalf of yourself or the organization you represent
Agree to comply with all applicable laws and regulations in connection with your use of the platform
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2 Description of Service
Post Daily is a business-to-business (B2B) software-as-a-service (SaaS) platform that provides AI-powered marketing automation. Our services include:
Automated web crawling to build a product knowledge base from your website
AI-powered content strategy generation and content calendar planning
AI-generated marketing copy for multiple social media platforms
AI-generated images and short-form videos for marketing posts
Content review, approval workflows, and publishing to social media channels
Performance analytics and reporting
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice to active subscribers.
3 Account Registration and Security
To use Post Daily, you must create an account. You agree to:
Provide accurate, current, and complete registration information
Maintain and promptly update your account information
Keep your password confidential and not share it with others
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4 Free Trial and Subscription Plans
Free Trial
New users are eligible for a 14-day free trial with full access to platform features. No credit card is required to start the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the service.

Each plan includes different feature limits and usage quotas. Details of plan features are available on our pricing page and may be updated from time to time.
5 Payment Terms
All payments are processed securely through Stripe. We do not directly handle or store your payment card information.
Subscriptions are billed monthly on the anniversary of your subscription start date.
Subscriptions automatically renew each billing cycle until cancelled.
All fees are quoted and charged in US Dollars (USD).
You are responsible for any applicable taxes in your jurisdiction.
Failed payments may result in service suspension. We will attempt to notify you before suspending access.
6 Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting support.
Upon cancellation, you retain access to your plan until the end of your current billing period.
We do not provide prorated refunds for partial months of service.
If you cancel during your free trial, no charges will be incurred.
Refund requests for exceptional circumstances may be submitted to support@marketingcommandcenter.com and will be reviewed on a case-by-case basis.
7 Acceptable Use Policy
You agree not to use Post Daily to:
Send spam - Generate or publish unsolicited bulk messages, spam, or content that violates anti-spam laws (CAN-SPAM, GDPR, etc.)
Publish illegal content - Create, store, or distribute content that is illegal, defamatory, obscene, threatening, or violates any applicable law
Scrape or steal content - Use the platform to scrape, copy, or republish content owned by others without authorization
Impersonate others - Misrepresent your identity or create misleading content that impersonates another person or brand
Distribute malware - Publish links to malware, phishing sites, or other harmful content
Abuse the platform - Attempt to bypass rate limits, exploit vulnerabilities, reverse-engineer the platform, or interfere with other users' access
Violate platform policies - Use the service in ways that violate the terms of connected social media platforms
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice or refund.
8 Intellectual Property
Your Content
You retain all ownership rights to the content you create, upload, or input into Post Daily, including your product knowledge base, brand guidelines, and original marketing materials.
Generated Content
Marketing content generated by the platform on your behalf (posts, images, videos) is owned by you, subject to any applicable limitations from the underlying AI service providers' terms.
Our Platform
Post Daily, including its software, design, logos, documentation, and all related intellectual property, remains the exclusive property of Post Daily. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the platform as a subscriber.
You grant us a limited, non-exclusive license to use your content solely for the purpose of providing our services (e.g., sending your content to AI APIs for generation, publishing to social media on your behalf).
9 AI-Generated Content
Content generated by Post Daily is created using artificial intelligence and should be reviewed before publishing.
All marketing copy, images, and videos produced by the platform are AI-generated using third-party AI services (Anthropic Claude for text, fal.ai for images and video).
AI-generated content may contain inaccuracies, errors, or unintended meaning. You are solely responsible for reviewing, editing, and approving all content before publication.
We do not guarantee that AI-generated content will be free from errors, bias, or intellectual property concerns.
You are responsible for ensuring that all published content complies with applicable laws, regulations, and the terms of service of the platforms where it is posted.
Post Daily is not liable for any claims, damages, or losses arising from your use or publication of AI-generated content.
10 Third-Party Services
Post Daily integrates with the following third-party services. Your use of these services is subject to their respective terms:
Anthropic (Claude AI) - Text content generation
fal.ai - Image and video generation
Buffer - Social media scheduling and publishing
Facebook / Meta - Social media publishing
Instagram - Social media publishing
X (formerly Twitter) - Social media publishing
LinkedIn - Social media publishing
TikTok - Social media publishing
Stripe - Payment processing
Resend - Email delivery
We are not responsible for the availability, reliability, or terms of third-party services. Changes to third-party APIs or terms may affect platform functionality.
11 API Key Security
You are responsible for obtaining and providing your own API keys for third-party services where required.
API keys you provide are encrypted and stored securely in our database.
You are solely responsible for maintaining the security of your API keys and for any usage or charges incurred through those keys.
You must not share API keys that belong to other individuals or organizations without authorization.
If you believe an API key stored in our platform has been compromised, you should immediately revoke it with the issuing provider and update it in your account settings.
12 Data Ownership and Portability
Your data belongs to you. We believe in data portability and transparency:
You own all content, knowledge base entries, and marketing materials stored in your account.
You can export all your data at any time using the built-in data export feature in your account settings.
Exported data is provided in structured, machine-readable formats.
Upon account termination, you may request a final data export within 30 days.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Post Daily is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or secure.
In no event shall Post Daily, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill.
Our total cumulative liability for all claims arising from or related to these Terms or your use of the service shall not exceed the total amount you paid to Post Daily in the twelve (12) months preceding the claim.
14 Indemnification
You agree to indemnify, defend, and hold harmless Post Daily, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
Your use of the platform or any content you publish through it
Your violation of these Terms or any applicable law
Your infringement of any third-party rights, including intellectual property rights
Content generated at your direction and published to third-party platforms
15 Termination
By You
You may cancel your subscription and terminate your account at any time through your account settings or by contacting support. Upon cancellation, you retain access until the end of your current billing period.
By Us
We may suspend or terminate your account immediately, without prior notice, if:
You violate these Terms or our Acceptable Use Policy
Your use of the platform poses a security risk or may cause harm to other users
Required by law or legal process
Your account has been inactive for more than 12 consecutive months
Effect of Termination
Upon termination, your right to use the platform ceases immediately. We will retain your data for 30 days to allow for export, after which it will be permanently deleted in accordance with our Data Deletion Policy.
16 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions.
Any legal proceedings arising from these Terms shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.
17 Dispute Resolution
Informal Resolution
Before filing any formal legal claim, you agree to first contact us at support@marketingcommandcenter.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
If informal resolution fails, any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Broward County, Florida.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void.
Exceptions
Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
18 Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes:
We will update the "Last updated" date at the top of this page
We will notify registered users via email at least 30 days before material changes take effect
We will post a prominent notice on the platform dashboard
Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the platform and cancel your subscription.
